Seems to be the only reason why Jersh is doing this is to minimize any legal liabilities in regards to the Destiny drama.

He's just looking out for his own self-interests, nothing more.

Last MATI Josh conceded that (under looming legal threats from streamer Steven "Destiny" Bonnell) he has placed restrictions on all of his and his friends' revenge porn that requires users to register an account to see it. This comes after 4 months of it being widely available and crashing his website. Josh needs to explain why it took him over 100 days to hide the revenge porn from the public, which is supposed to be "standard practice" during it's first usage on Kiwifarms.

He claims he is "stuck in an uncomfortable situation" and explains before the timestamp above that he dislikes that Destiny didn't bother going after other websites (twitter? discord?) when everyone knows Kiwifarms was the biggest source of the leaks and the leaker specifically selected Kiwifarms to dump everything and launder it to the internet. Josh claims his insistence on hosting revenge pornography is some kind of "freedom of information" issue. What Josh doesn't tell his users is that people intentionally use Kiwifarms to dump information and revenge porn on lolcows because Josh will protect it. If you're unfamiliar with this idea, a Kiwifarms user recorded himself having sex with the drug-addled sister of DSP's wife. Josh banned the user for this behavior, but kept his revenge porn on the website. DSP called Josh out on hosting such content on his website as the user only did this because he hated DSP and told Josh how stupid it was to ban the user and not the content because people will just make new accounts (or use alt account) to post similar content knowing Josh won't delete it. Josh stuttered and stammered throughout his response and could only give weak answers. Any sensible person knows DSP is speaking truth.

What did Josh concede days later at the end of his stream when a donator rightly told him his response to DSP was pathetic?
"She's a whore. She's a literal backpage prostitute and i don't give a fuck what happens to her. As far as morals go I don't give a shit."

Loser pays. If you sue someone and you lose, you have to pay the other side's legal fees as well as your own. It's not the law in the USA but it is just about anywhere else.

However, now I'm curious. What exactly was he trying to catch? What bait was he using, if he was using any at all, unless he just decided to ONLY stick a hook on the rod and wing it? Where exactly was he fishing and did he do his research to find out which time of day and/or low/high tides? (probably not).

Based off his comments, he's moved into the swamps of Florida to start building a compound for the inevitable attempts on his life by Antifa. That's why he mentioned tinned fish, because he's trying to stock up on preservable food.
