I get documenting public incidents if there is some context worth discussing, but turning it into a running archive of someone’s “breakdowns” seems like it could get pretty personal pretty fast.


Probably better to stick to specific clips or statements and discuss what was actually said rather than trying to diagnose the guy or label every angry moment as some kind of mental episode.


There is usually enough material to criticize without guessing about someone’s mental health.

Here's the letter. It's worth reading just to see how slimy, sycophantic, and cajoling these lawyers are. The lawyer Jay Wolman is sucking up to the judge and brown-nosing in order to try to influence the judge into now doing extra stuff for him that he wants done. The cover story is that you submit the work to be cited for other lawyers to draw upon in their own cases. To establish a body of work of case law. But lets's be honest. It's about ego. When the lawyer wins (or at least thinks he's done well), he wants his name and ego to echo throughout the legal literature. He thinks he's important and has a massive ego. I also would bet that Josh Moon and Matt Hardin were urging the Randazza lawyers to do this because Moon wants it badly so he can feed his ego and feel super special, like he's going down in the history books.

In order for your case to get published in the literature, it should be "significant and worthy." Of course every narcissistic lawyer thinks his shit is important, but it's not. I don't disagree with you, even in this political climate; unless tomorrow America becomes socially collectivist or is subjected to a brutal and intolerant dictatorship then the LGBT rights movement will always be present.

But I will say this, political trends always come and go but the political sides will always be here in some form.

When it comes to the Right, there will come a time when MAGA will collapse (like how the Tea Party movement collapsed) the moment Trump leaves public office. MAGA was built around a cult of personality around Trump and whatever comes after this is anyone's guess. I'm sure things like being anti-illegal immigration will continue being part of the GOP's platform after Trump along with the GOP still continuing to promote traditional family values, being pro-business, and other conservatives polices. But one thing is for sure, MAGA and the Dissident Right as we know them today will most likely fade from relevancy after Trump is gone. What will a post-MAGA Right look like? Who fucking knows.

With the Left, the whole Breadtube Progressivism we've seen in the past decade has been fracturing (like how Occupy Wall Street imploded) as people like Hasan Piker are seen as lolcows and like how the mainstream GOP and mainstream Conservatism are starting to cut their ties with their more fringe elements, the Democrats and Liberals have been cutting their ties with the more extreme factions of the Left because like how people like Nick Fuentes or Tucker Carlson have become liabilities for the mainstream American Right, people like Hasan 'I Shock My Dog' Piker have become liabilities for the American Left now. What will a post-Breadtube Left even look like? who fucking knows either.

As for the LGBT community, if there is one change I can see happening within this movement in the near future is the advocates for queer rights simply stop listening to the retarded troons promoting bad ideas. The big reason why some governments are backtracking on LGBT rights and why support for LGBT rights has declined in recent years is because the troons keep making the entire LGBT community look bad with their stupidity. There will always be a Left and a Right that will fight over how a nation should be run. But if history is an indicator for anything, pragmatism always wins out while fringe ideologies get left behind and become trivia in a history book. The Left and Right will continue to exist while MAGA and Breadtube Progressivism will eventually end up like the Tea Party movement and Occupy Wall Street where they will be treated as history trivia rather than long lasting movements someday. America is not the only nation on Earth that uses pop culture to promote consumerism. Shit like this is why I'm now skeptical these days that Jersh even traveled outside of America and I now seriously doubt he lived in Serbia for a while. Anime and manga has always been used for commercialism for decades in Japan long before this made its way into America.

The court has provided a transcript of the August 27 court hearing with LFJ and Josh Moon's lawyers. There was very little input from either side's lawyers as they had already submitted their arguments in written form. Instead, the judge just read out her statement ruling on what she was going to do. I'll give you the quick summary below. 28 pages squished down into one sweet paragraph.

The judge ruled that all the pics KF'ers posted were transformative and thus constituted fair-use works. So she quashed LFJ's subpoenas to get KF'ers' info as part of his claim that the pics had violated his DMCA copyright. Josh's side argued that LFJ should pay their legal fees since it was undue burden on the KF'ers. But the judge turned this down and refused because LFJ made good-faith attempts to stop the pics from being used so it was reasonable and not bad enough to made him pay the legal fees. The judge called some of the pics "racist" and "transphobic" but said she didn't have to agree or condemn the pics because it's protected first-amendment content. On Hardin's preliminary injunction motion: This was blocked by the court and they didn't grant it for Joshy. Basically, Josh's side was asking for LFJ to never be able to issue another DMCA takedown request towards Kiwi Farms again. And the judge argued that future DMCA takedown requests must be looked at individually, like she did here today, and that we can't just blanket assume that future requests aren't legitimate. So this is Josh's side getting really greedy. The judge then made it clear that if future DMCA takedowns come from LFJ, the judge will probably ask LFJ to pay for attorney fees for the other side because at that point, it would look more like LFJ is trying to cause undue financial harm to KF'ers. Finally, they agreed to rejoin on September 25th to see where both sides stand and what they want to do going forward.

My commentary:

While it would have been funny to see Josh's side get blown apart and his KF'ers doxxed, it's also refreshing to see the judge rule accurately that the pics were fair-use according to DMCA copyright law. So it is nice to see the US court system working as it should. But let's be real. Judges can do whatever they want. If they wanted to fuck Josh, they could fuck Josh and use whatever argument they could within the law to do so. It just happened to go their way today. This is a case of a judge interpreting the law as written, and then literally applying it to the case of the DMCA pics. LFJ was using DMCA as a smokescreen to fuck KF'ers by getting their doxxes but the judge just literally looked at each pic and applied DMCA copyright law. So the pics were ruled as transformative and LFJ got his subpoenas denied.

For LFJ's lawyers, it's sort of baffling how they didn't realize their case wasn't strong enough to realize the pics were transformative. I guess they were just banking on the hope that they would get an activist judge that would be sympathetic to their side and rule in their favor. They should have made better arguments or found some other way to attack Josh. For example, Josh was trying to delete user IP data and he was changing his policies on IP data retention while the case was ongoing (and after he received the DMCA takedown requests). That is arguably illegal or at least extremely murky. I didn't read all those documents where they made all their arguments but it just seems like a poor showing from the LFJ lawyers' side. Anybody with half a brain that used the internet in the past 15 years knows that if you take something like a video or pic and then add something to it, it becomes transformative in the legal sense. We have seen this on Youtube with people uploading other people's content. And there was that case with Sargon of Akkad versus Akilah Hughes where his videos were deemed as fair use when he chopped up her videos and then reuploaded them, even if it was just small changes to the original videos. That was a case directly involving DMCA law and the fact that LFJ's lawyers couldn't look at that and realize the pics were going to be fair-use, is baffling. They should have done their homework, I guess.

The other day, I discussed how Randazza's lawyer Jay Wolman was trying to urge the judge to submit this case's ruling to a federal supplement. To basically try to add it to important court literature that others could refer back to, in the future. Josh Moon and Hardin wanted this badly too. It was basically a big ego stunt to perform autofellatio on themselves, so to speak. As this case is really not all that important or significant, except in Joshy's own mind. Well, the judge denied it and smacked it down. Lmao. Sorry, Randazza, Wolman, Hardin, and Joshy. You're not nearly as important as you think you are.

So to conclude:
1. The judge quashed LFJ's subpoenas so the KF'ers doxxes are safe, for now.
2. Josh's side wanted to force LFJ to pay for the KF'ers legal fees. This was denied. So the 10 KF'ers had to pay thousands in legal fees or perhaps the lawyers were forced to do it pro-bono (do it for free). Pretty funny, regardless. Josh really should open up that >100K he raised from KF'ers for legal battles and pay up. But he probably won't since he's a greedy scumbag.
3. Josh's side wanted a preliminary injunction motion so that LFJ could never DMCA the Kiwi Farms ever again. This was denied.
4. Josh's side wanted for this ruling to get submitted as a part of the legal literature because they think they're big boys now. This was denied.

So despite Josh's spin that it was a massive conquering victory, they still didn't 3/4 things they wanted, because they were greedy. But they did get the main thing they wanted which was to quash the subpoenas though.
