Average kiwifarmers don't understand Fair use. Fair use is a defense you try to use in court that they have to decide whether or not if it's applicable. Not just some blanket claim people can make to keep from getting sued. People misunderstand what the term actually means all the time. You can try to use it as a defense in court but they ultimately decide if it applies or not. Plus many countries like Japan don't have that as a legal defense. You also wouldn't be able to use places like China for violating copyright laws. I am against copyright laws.Josh once again misrepresents the courts.

It's not that the DMCA is a legal liability, but that Josh knew full well he was hosting copyrighted material, mocked Greer for it, dared Greer to sue him about it, then claims that his hosting of copyrighted material is somehow "fair use." The courts determined that Josh is facilitating copyright infringement and encouraging his users to do the same (which he very well does) due to his very conduct.
