He's suing LFJ in New York under 28 USC paragraph 2201
So LFJ threatened to sue Null for copyright infringement, but Null claims that copyrighted materials were used in the context of protected Fair Use criticism, so that doesn't constitute a copyright violation.
If I understand this correctly, Null wants the NY court to affirm that KiwiFarms has a Fair Use right enable users to criticize public figures such as LFJ, including the use of copyrighted materials such as a Bsky post or a troon's glamour shot as part of that Fair Use criticism, and since such a judgement under USC 28 section 2201 has "the force and effect of final judgement", then LJF will not be able to file the copyright lolsuits he's been threatening to file against KF. So Null is using USC 28 to pre-empt LFJ carrying out his legal threats.
I have a question about this statement though, in paragraph 8 on page 3:

I wouldn't exactly refer to a plainly bad faith copyright complaint over a Bsky post and a glamour shot as "restarting #DropKiwiFarms". This copyright thing with the Bsky post and the glamour shot rather seems like the kind of complaint that a troon would attempt when he knows he no longer has any cultural currency in the US legal system. LFJ knows he can't go to court in US right now and crybully his way to a victory just by being an aggrieved troon, so he's acting more like a matter-of-fact businessman this time claiming his copyrights were violated, and gimme money pronto. Again, I need to see if other social media platforms have already used 28 USC p. 2201 as a way to pre-empt malicious copyright complaints from proceeding. I won't comment on the prospects of Null's lolsuit against LFJ until I've done more research.

Check the lawsuit page on Kiwi Farms. Hardin asserts that one picture is fair use because it is necessary to illustrate the subject for the purpose of the commentary (which was ample and explicitly about the photograph), and the other was edited with text which also constitutes commentary as well as parody (as it uses the consent accident meme). It also appears that Hardin is arguing from copyright law while LFJ's lawyers believed Hardin was using BlueSky's own terms of use to assert fair use. So in that respect, Hardin is one step ahead.
Where I would not be so confident is the lack of proper response to the DMCA claims, as well as the first image. Wikipedia for instance does not use photographs it cannot assert proper copyright claim toward, sometimes even on famous people's articles. Kim Jong Un had some random guy's sketch of him for years because news media owned the copyrights to official North Korean pictures and for whatever reason North Korea's own copyright laws were respected, or something like that. To my knowledge, this situation might be different because the infringing post specifically provided commentary on LFJ's picture while a Wikipedia article on Kim Jong Un is about the subject as a whole.
In any case, I do not think this is an attack on free speech. LFJ is not making new laws or precedents, since DMCA trolls have been around since the DMCA itself. LFJ is using this to settle an old conflict that he himself started (Kiwi Farms ignored him until ~2021 when he started freaking over a 2 year old thread laughing at his 2019 DMCA request) and to put it on his resume for his reputation management company that he was the guy who took down the big bad Kiwi Farms. For people Null explicitly hates and targets, LFJ is among the least sympathetic because he basically started this entire thing himself.
He was which is why he's getting around it this time by having Hardin create the fund.
Copyright issues aside, Josh's mods are too afraid to tell him that he literally IS defaming LFJ by calling him a "credibly accused rapist." The problem is that even if he wins this case, there's going to be another and another and another until the troons get what they want. There's blood in the water thanks to the fecklessness of Trump's presidency, that's why Jones feels confident enough to return and try another attempt at taking out Kiwi Farms. Keep in mind that Null's donations, as big as they are now, only got to that point due to a mixture of Jones doing his lawsuit, making people realize that they'll be next when Null falls and Null telling his users they needed to donate now or he was shutting KF down.
